SMS Privacy Policy

The Black Mental Health Corporation ("TBMHC," "we," "us," or "our") respects your privacy. This SMS Privacy
Policy explains how we collect, use, protect, retain, and handle information associated with our text-
messaging program. This section supplements our broader privacy practices and applies specifically to SMS
and MMS communications.
1. Program scope and message type
When you expressly opt in, TBMHC may send conversational messages only. These messages consist of back-
and-forth responses to consumer questions and service-related inquiries.
2. Information we collect
In connection with the SMS program, we may collect your name, mobile telephone number, the date, time,
and method of your opt-in, your consent record, message content and messaging history, delivery
information, HELP and STOP requests, and other information you voluntarily provide through text messages.
3. How we collect SMS consent
TBMHC may collect consent verbally during a telephone or in-person conversation, through a compliant
online form, or through another documented opt-in method disclosed at the point of collection. Consent is
specific to TBMHC and the mobile number provided. Consent to receive text messages is voluntary and is not
a condition of purchasing or receiving healthcare or other services. We will maintain a record of the consent
provided.
4. How we use SMS information
We use SMS information only to operate the text-messaging program, provide the communications you
requested, respond to you, maintain consent and opt-out records, protect the security and integrity of the
service, comply with applicable law, and support our internal operations related to those purposes.
5. Use of Contact Information
Any contact information you provide when responding to a message will be used to communicate with you,
respond to your inquiry, and provide follow-up related to your request. We use that contact information only
for the conversational SMS program and related permitted business purposes described in this policy.
6. Data Sharing
Clear data-sharing statement. We do not share SMS consumer data with third parties. Your data will not be
transferred to external organizations. Mobile/SMS opt-in data and consent are not shared, sold, rented, released,
or transferred to third parties or external organizations.
SMS-related personal information is used internally only as needed to operate TBMHC's SMS program,
provide back-and-forth responses to consumer questions and service-related inquiries, maintain consent and
opt-out records, and respond to questions about the SMS program.
7. Data Safeguards and Access Controls
We maintain reasonable administrative, technical, and physical safeguards designed to prevent unauthorized
access, use, or disclosure of user data. Access to SMS data is limited to authorized TBMHC personnel and
permitted business purposes only. Authorized personnel may access SMS data only as needed to operate and
support the SMS program, respond to consumer questions and service-related inquiries, maintain consent
and opt-out records, protect the security and integrity of the service, and comply with applicable law. No
method of transmission or storage is completely secure.
8. Message frequency and charges
Message frequency may vary. On average, you may receive one to two messages per month. Message and
data rates may apply according to your mobile carrier and service plan. TBMHC does not charge a separate
fee for participating in the SMS program.
9. Your choices: STOP and HELP
You may opt out at any time by replying STOP to any TBMHC message. After you send STOP, we will send one
confirmation message stating that you have been unsubscribed, and no further SMS messages will be sent
unless you provide a new opt-in. For assistance, reply HELP, call 216-512-0321, or email
helpline@tbmentalhealth.com. Opting out of SMS does not prevent TBMHC from contacting you through
other lawful methods when appropriate.
10. Privacy, health information, and emergencies
Standard SMS may not be encrypted and may be accessible to your mobile carrier, device users, or others
with access to your telephone. Do not use SMS for emergencies or urgent medical or mental-health needs.
Call 911 for an emergency. You may ask TBMHC to use another communication method. TBMHC handles
protected health information in accordance with its Notice of Privacy Practices and applicable law; this SMS
policy does not replace that notice.
11. Data retention
We retain mobile numbers, consent records, opt-out records, and message history for as long as reasonably
necessary to operate the conversational SMS program, document compliance, resolve disputes, meet
recordkeeping obligations, and comply with applicable law and healthcare requirements.
12. Access, correction, and deletion requests
Subject to applicable law and healthcare recordkeeping obligations, you may contact us to ask about SMS
information associated with you or request that inaccurate information be corrected or eligible information
be deleted. We may need to verify your identity before acting on a request.
13. Changes to this policy
We may update this SMS Privacy Policy. We will post the revised policy on this webpage and update the
effective date. Material changes will apply prospectively as required by law.
